The UST Technical Appeals Panel (TAP) is composed of five regular members and two alternates who are appointed by the governor. TAP arises from Arizona Revised Statutes (ARS) § 49-1093. The panel may be requested by the administrative law judge (ALJ), the appellant or the department to participate in a hearing arising from a final decision or determination issued pursuant to ARS § 49-1091 (informal appeals process). The panel hears testimony, reviews evidence and prepares written findings of fact regarding matters addressed in the department's final determination or decision. The technical findings of fact are adopted into the ALJ's recommendation to the director unless the ALJ determines the findings of fact are technically invalid.
