Amending a Solid Waste Facility Plan
The owner/operator of a solid waste facility is required to notify ADEQ of any change to the facility. ADEQ will determine the category of the change. As required by statute, certain changes will require plan review, fees and public notice. Before implementation, the director shall approve a type III or type IV change to the design or operation of an approved solid waste facility.
Below are listed the category types of proposed changes to a solid waste facility:
Type I
A type I change is an insignificant modification that does not require notification to the department. This includes changes to a facility that are not directly related to the replacement of equipment or structures with similar items.
- Examples include:
- Cosmetic changes at a landfill
- Purchasing a new pickup truck
- Changing accountants
- No notification to ADEQ is required
- No plan review is required
- No fee payment is required
- No public notice is required
Type II
A type II change is a minor modification that requires notification to ADEQ. This includes changes to a facility that are directly related to the physical management of solid waste that do not required detailed review by the department.
- Examples include:
- Minor changes in construction to that approved by the department (four guard posts instead of three)
- Rewording permit language for clarification
- Certain financial assurance demonstrations
- Notification to ADEQ is required
- No plan review is required
- No fee payment is required
- No public notice is required
Type III
A type III change is a substantial change that does not require public notice. This includes changes that are significant, that require detailed review by the department and that are equally or more protective of the public health and environment, changes that re required by statute or regulation or other substantial changes that are not type IV changes.
- Examples include:
- Yearly financial assurance demonstrations
- Alternative daily cover approvals
- Significant changes to ground water monitoring
- Significant corrective action plan changes
- A change in landfill ownership
- Changes in structural components
- Notification to ADEQ is required
- Plan review is required
- A fee payment is required.
- No public notice is required
Type IV
A type IV change is a substantial change that requires public notice. This includes significant changes in the total storage, process, treatment or disposal capacity of the solid waste facility. A type IV change also includes a lateral expansion of an existing solid waste landfill or the addition of a process or a major piece of equipment for which the net effect of the change will be an increase in discharges.
- Examples:
- The lateral expansion of an existing facility
- A change in methane monitoring frequency
- A change in height of a landfill
- Opening a private landfill to the public
- A change in landfill status
- Notification to ADEQ is required
- Plan review is required.
- A fee payment is required.
- Public notice is required.
