Waste Programs Division: Solid Waste Management: Solid Waste Facilities Rulemaking

The purpose of this rulemaking (formerly known as the Integrated Solid Waste Regulatory Framework rulemaking) is to establish a systematic and comprehensive framework for regulating solid waste facilities and solid waste streams in Arizona. This rulemaking will integrate and implement statutory provisions related to best management practices, self-certification requirements, plan approval procedures, financial assurance requirements, design and operation rules for solid waste facilities, and other topics. Facilities that may be affected by this rulemaking include landfills, treatment facilities, transfer facilities, waste tire facilities, composting facilities, and recycling facilities.

On Jan. 14, 2009, ADEQ filed a Notice of Proposed Rulemaking (NPRM) with the Secretary of State for publication in the Arizona Administrative Register, anticipating that the NPRM would be published in the Register on Feb. 6, 2009. ADEQ notified stakeholders of the filing of the NPRM and provided them with an unofficial version of the NPRM. The NPRM was withdrawn prior to publication pursuant to the Governor's Regulatory Review Plan Memorandum of Jan. 22, 2009. (15 A.A.R. 376 and 381) Leaving ADEQ Web site.

From May 2007 through July 2008, ADEQ engaged stakeholders affected by the establishment of these rules in an informal public participation process prior to filing an NPRM under the state's Administrative Procedure Act. ADEQ worked directly with all affected stakeholders to ensure that their issues and concerns were consistently understood and considered.
